The state high court said Mr. Trump’s attorneys had failed to demonstrate that the case represented “one of the very rare circumstances” in which lower courts needed to be avoided.
Trump’s legal team is pending a similar request in Atlanta’s Fulton County Superior Court to bar the special grand jury’s work and reports from being used in future civil and criminal cases.
In a petition four days ago, Mr. Trump’s attorneys acknowledged that it was highly unusual for the state Supreme Court to hear the case because it normally reviews appeals from lower courts.
But they argued that the court should address the issue directly, in part because of former president and 2024 presidential candidate Trump’s position.
And, as with the Fulton County Court petition, the attorneys argued that the evidence put together by the special grand jury in the election investigation was “illegally obtained.”
In denying Trump’s petition on Monday, the Supreme Court ruled that “petitioners have sought to avoid the court’s original jurisdiction as a way of circumventing the usual routes of obtaining the relief they seek without showing that they are being equitably barred.” I made it clear that I can’t activate it.” You can access those regular channels. ”
And Trump “has made no indication that fair access to normal channels has been prevented,” the judges wrote.
A lawyer for Trump did not respond to a request for comment on the Supreme Court’s ruling.
A special grand jury heard evidence and testimony from dozens of witnesses last year but had no power to remand the charges.
Last week, two standing grand juries from the Superior Court Enhancedwill soon be tasked with deciding whether to file criminal charges against Trump and his allies.
Willis’ criminal investigation has prompted Trump to call Georgia Secretary of State Brad Ravensperger to pressure him to “find” enough votes to reverse Biden’s victory in the state. It began in 2021, shortly after it was publicly exposed.
Ravensperger refused the request, but it will either reverse Biden’s defeat in the Electoral College by Trump and his allies, or result in several key battleground states such as Georgia. It was part of an effort to create enough suspicion to throw a decision on who would win Mr. Biden. He becomes Speaker of the House.
Trump is currently the frontrunner for the 2024 Republican presidential nomination.
Since starting his campaign, he has already been charged with two other criminal cases.
In New York state court in Manhattan, he pleaded not guilty to charges of falsifying business records related to a 2016 hush payment to porn star Stormy Daniels.
He also pleaded not guilty in federal court in Florida to charges related to keeping classified records after leaving the White House.
